ABOUT US
TMBTQ Trademark Law Boutique is a law firm focused on “soft” intellectual property including trademark and copyright law. We help both established businesses (especially multi-generational family-owned businesses) and entrepreneurs protect their most important assets — their brands. We specialize in comprehensive trademark searching, clearance, analysis and representation of clients interested in protecting and registering trademarks with the U.S. Patent and Trademark Office.
WHAT WE DO

TRADEMARK CLEARANCE
We search availability of numerous databases not only for exact matches, but also for other similar marks that may be lurking out there and come back to bite you. We evaluate your proposed mark to minimize the risk associated with creating, using, or expanding the market or geographic area of your brand. Feel confident that infringement risk is low.

TRADEMARK PROTECTION & MONITORING
Ensure your valuable trademarks are monitored and enforced with our streamlined and cost-efficient range of trademark watching services. We also ensure that your advertising is compliant with Federal Trade Commission regulations, so you’re not making promises or statements that you shouldn’t.

TRADEMARK REGISTRATION
Our focus is registering your unique company name, product or service name, tag line or logo with the United States Patent and Trademark Office. We have a high rate of success because of our unique process and attention to your brand.

SHUT DOWN FRAUD
We strategically enforce and defend your brand against copycats, from sending cease and desist letters, to opposition or cancellation proceedings with the Trademark Trial and Appeal Board, or escalating matters to Federal court.

TRADEMARK DISPUTES
If you are involved in a trademark dispute with a competitor or someone who claims that you’re copying their product, company or service name, we are here to represent you and protect your rights. We handle matters with the Trademark Trial and Appeal Board (TTAB) and Federal Court.

ADVERTISING COMPLIANCE
If you advertise your products or services to the general public, there are Federal Trade Commission (FTC) regulations you need to comply with! We can advise you on compliance and represent you in matters before the FTC or the Better Business Bureau’s National Advertising Division (NAD).
WHO WE HELP
TMBTQ is a boutique law firm dedicated to trademark, copyright, entertainment law, and brand protection. We proudly represent a diverse range of clients, from multi-generational family businesses and fast-growing entrepreneurs to leading consumer product companies, software developers, artists, musicians, and entertainment companies.
With decades of combined experience, we understand the unique challenges each group faces. Established businesses look to us to preserve their legacy while expanding into new markets. Entrepreneurs trust us to help them build strong foundations for growth. Software developers rely on us to protect their code, technology, and digital assets. Artists and musicians count on us to safeguard their creative work and negotiate fair agreements. Entertainment companies turn to us to manage complex licensing, distribution, and brand protection matters.
What unites all of our clients is the need for clear, effective, and forward-thinking legal guidance. At TMBTQ, you receive the best of both worlds — the deep expertise and strategic insight of a large firm, combined with the responsiveness and personal attention of a boutique practice.

Established Businesses
If you are involved in a trademark dispute with a competitor or someone who claims that you’re copying their product, company or service name, we are here to represent you and protect your rights. We handle matters with the Trademark Trial and Appeal Board (TTAB) and Federal Court.

Emerging Entrepreneurs
We have been working with first-time business owners since our firm was founded in 2007. Our owner, Tamara, is an entrepreneur herself, having created, marketed, and sold all of the initial batch of board games she launched in 2003, so she understands the challenges and dreams that entrepreneurs experience.
Trademark Registration Process
Registering a trademark with the U.S. Patent and Trademark Office is not just a matter of clicking some buttons on the USPTO website and submitting a form. There are several steps and potential twists and turns along the way. We have created this infographic to show the process for registration of a basic trademark for a product or service that is already in use. Currently, in the best case scenario, if there are no administrative of substantive issues resulting in an Office Action, the entire process takes about 12-13 months. Our most popular package involves representing clients from the initial clearance search, all the way through registration.
